Acceptance of Terms

By using this website, requesting a quote, or booking a shipment with Apex Freight ("Apex Freight," "we," "us," or "our"), you agree to these Terms of Service. If you're using our services on behalf of a company, you're agreeing on that company's behalf and confirming you have the authority to do so. If you don't agree to these terms, don't use the site or our services.

Description of Services

Apex Freight is a freight forwarder: we arrange the transportation of goods by air, ocean, and ground on behalf of our customers, using a network of carriers, and we are not ourselves the underlying air, ocean, or motor carrier for every leg of a shipment. Where we act as a broker arranging carriage through a third-party carrier, that carrier's own tariffs, terms, and liability limits may also apply to your shipment in addition to these terms.

Quotes & Pricing

Quotes provided through this website, by phone, or by email are estimates based on the information you provide (weight, dimensions, origin, destination, and service type). Final pricing may differ based on the shipment's actual weight and dimensions, applicable fuel surcharges, accessorial fees, customs duties, and other charges determined at the time of shipment. A quote is not a binding rate until a shipment is booked and confirmed.

Booking, Payment & Cancellation

Shipper Responsibilities

As the shipper, you're responsible for:

  • Providing an accurate description, weight, and value of the goods being shipped
  • Packaging goods appropriately for the mode and duration of transit
  • Ensuring goods aren't prohibited or restricted for the origin, destination, or transit route (see below)
  • Providing accurate documentation, including any customs, export, and hazardous materials paperwork required for your shipment
  • Any delay, cost, or penalty that results from inaccurate or incomplete information you provide

Prohibited & Restricted Items

Certain goods cannot be shipped, or require additional documentation and licensing, under U.S. import/export law and the rules of individual carriers. See our Shipping Regulations page for an overview. We reserve the right to refuse, hold, or return any shipment that violates applicable law or carrier policy, at the shipper's expense.

Liability & Cargo Insurance

Our liability for loss or damage to your shipment is governed by the law applicable to the mode of transport used, which may include the Carmack Amendment for domestic motor carriage, the Montreal Convention for international air carriage, and COGSA or the Hague-Visby Rules for ocean carriage. These frameworks typically limit a carrier's liability to a set amount per pound or per package, which is often less than the full value of the goods.

We strongly recommend purchasing cargo insurance for any shipment where the declared value exceeds the carrier's standard liability limit. [Describe any cargo insurance you offer directly, or note that it's the shipper's responsibility to arrange.]

We are not liable for loss, damage, or delay caused by the shipper's improper packaging, inaccurate documentation, the inherent nature of the goods, acts of God, or other causes outside our reasonable control.

Delays & Force Majeure

Transit times are estimates, not guarantees, unless a specific guaranteed service is purchased and confirmed in writing. We are not liable for delays caused by customs holds, weather, carrier schedule changes, port or airport congestion, labor disputes, or other events beyond our reasonable control.

Claims Process

Loss or damage claims must be submitted in writing within [X days] of delivery (or, for shipments that never arrive, within [X days] of the expected delivery date), and must include supporting documentation such as photos, the packing list, and the commercial invoice. Claims submitted after this window may be denied. We review submissions before publishing and reserve the right to decline or remove any submission at our discretion, including content that is false, abusive, or unrelated to our services.

Indemnification
